If any provision of the Terms of Use is found to be invalid by any court having competent jurisdiction, the invalidity of such provision shall not affect the validity of the remaining provisions of the Terms of Use, which shall remain in full force and effect. The failure of the Company to enforce any part of the Terms of Use shall not be deemed a waiver thereof and shall not prevent its later enforcement.
